Terms of Service

1. Acceptance

By downloading or using this app you accept these terms. If you don't agree, don't use the app.

2. What the Service Does

Davetiye uses generative AI to create event invitation images based on the event details you provide (event type, names, date, venue). You can share the resulting invitations as PDFs or images.

Davetiye is not an event platform. It does not provide RSVP collection, guest management, or calendars.

3. Your Account

• We don't ask for personal information to sign up. The app uses an anonymous device-bound identifier.
• If you change devices or uninstall and reinstall the app, you may lose access to your past invitations and credit balance.
• Reinstalling on the same device with the same Apple ID lets you restore purchased credits via Restore Purchases.

4. Paid Features and Credits

4.1 Credit packs

• Each invitation generation costs 1 credit.
• Removing the watermark from an invitation costs 1 credit.
• New users receive 1 free credit.
• Additional credits are purchased through the App Store.

4.2 Refund policy

• Credits are treated as digital content. No refunds after purchase.
• Apple's refund policy applies: you can request a refund at reportaproblem.apple.com. If Apple issues a refund, the corresponding credits will be deducted from your balance.
• Under Turkish Consumer Protection Law (Art. 15/1-ğ), digital content delivered instantly is not subject to the statutory right of withdrawal.

4.3 Watermark removal

• Free invitations include a branded watermark.
• Removing the watermark is a purchase: it consumes a credit and is permanent.
• Watermark-free output is a paid feature, not part of the free service.

4.4 Price changes

• We may update credit pack prices. Credits already purchased are not affected by future price changes.

5. AI-Generated Content

5.1 How it works

• The information you enter is sent to AI providers (OpenAI and/or fal.ai).
• Generated images are stored on Firebase Storage and served to you as a link.
• The same input can produce different invitations; the result is not deterministic.

5.2 Ownership

• The text and photos you enter remain your property.
• You receive the right to use the generated invitation for personal and non-commercial purposes.
• The same or similar output may be produced for other users. We don't guarantee uniqueness.
• AI-generated images may not be eligible for copyright protection in some jurisdictions (e.g., the USA). Consider this when using them.

5.3 Prohibited use

You may not use the app to:

• Upload photos of another person without their consent
• Reproduce copyrighted works (e.g., famous paintings)
• Generate hate speech, violence, sexual or illegal content
• Create fake invitations featuring recognizable third parties (celebrities, politicians, living public figures)
• Commit fraud, misleading commercial communication, or spam

We may suspend or terminate your access if these rules are violated.

5.4 Reference photos

• Reference photos you upload are sent to OpenAI's vision analysis service (GPT-4o Vision).
• They are not used to train AI models (per OpenAI API's standard terms).
• If you upload a photo of another person, obtaining their consent is your responsibility.

6. Warranties and Liability

6.1 "As is"

The service is provided "as is" and "as available". AI models may produce incorrect output — misspelled names, missing dates or venues. It's your responsibility to review output before sharing.

6.2 Limitation of liability

To the fullest extent permitted by law, the service provider's aggregate liability for the service is capped at the amount you paid us in the last 12 months.

We disclaim liability for indirect damages, loss of profit, loss of data, or reputational harm.

6.3 Third-party services

Services like OpenAI, fal.ai, Google Places, PostHog, and Apple are not under our control. We are not liable for disruptions caused by their outages, errors, or policy changes.

7. Termination

You can terminate this agreement at any time by deleting the app. We may terminate your access if you breach these terms or if we decide to discontinue the service.

To delete your account, email info@daveto.app. After deletion, irreversible actions (including purchased credits) cannot be restored.

8. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Turkey. Disputes are subject to the Istanbul Çağlayan Courts and Execution Offices. Consumer claims may be filed with Consumer Arbitration Committees and Consumer Courts.

9. Changes

We may update these terms. For material changes we show an in-app notice. Continued use after the change constitutes acceptance.
